Condemn the repression and human rights violations in Iran and Join us to say No to the death penalty

On December 20th, 2012, an overwhelming majority of the UN General Assembly condemned human rights violations and the repression of human rights activists in Iran. This is not the first time that the UN General Assembly has condemned the dark and shameful record of the Islamic Republic of Iran (I.R.I) on violation of human rights.

The resolution cites the systematic and flagrant violation of human rights in Iran, the repression of political and social activists and the suppression of peaceful protests by workers, teachers, students, women, ethnic and religious minorities.  The Islamic Republic of Iran’s record on human rights has been condemned many times at the international UN summit. In appreciation of these initiatives, we would like to bring the attention of the international community and all the human rights activists to the following points:
                       
The Iranian legislation is not based on human dignity. The current rules have been formulated on the basis of Sharia laws.  The legislative body and those who implement the laws in the Islamic Republic of Iran have refused to recognize a universally accepted law, which deems all citizens as equal from the point of view of the justice system.  Based on the religious beliefs of a minority in the governing system, they have divided Iranians into different classes of citizens who are treated differently under the law. In fact, the running judiciary of this regime is in violation of many international conventions.

The judiciary is supposed to be independent of the executive branch in a modern and democratic society, but in the Islamic Republic of Iran it is just a tool in the hands of the governing body and the supreme leader, and has become the most effective instrument of suppression of Iranian citizens.   

In the past 34 years, Islamic Republic’s primary method of dealing with its people has been suppression of freedom and continuation of human rights abuses. To intimidate the population, the main tool of the Islamic Republic has been medieval punishments in all these years.  Brutal punishments such as stoning and amputation have been implemented since the inception of their rule.

Of all the various forms of punishment, the death penalty has been used as the most important means of intimidation by the Islamic Republic. The IRI judiciary, which can be called a Killing Machine, has issued tens of thousands of death sentences and ended the lives of tens of thousands of citizens brutally under different pretexts. In the past five years alone, 2,843 people have been executed in Iran. 

Over these years, of the tens of thousands of citizens who were executed by the Islamic Republic authorities, a large part has belonged to opposition groups. To strengthen the foundations of the regime, especially in the dark years after the 1979 revolution, executions were targeted at political opponents. In recent years, the death penalty is mostly used for non-political victims, but the judicial system is still a strong tool used by the security forces, and as a result death sentences continue to be used on opposition groups. 

Due to the fact that the Islamic Republic of Iran always utilizes retaliatory measures against political prisoners after each international condemnation, we would like to draw the attention of all freedom lovers, defenders of Human Rights and all governments the dangers facing political prisoners in Iran.    

Presently, many political, social and civic activists are sentenced to death and held in solitary confinement with their lives in imminent danger.  Using the historic occasion of the recent U.N. resolution, we are asking International Human Rights organizations and communities to give special attention to this matter. 
                         
In recent years, most of the executions in I.R.I. are comprised of ethnic Kurd, Arab and Baluch Iranians.  These Iranian ethnic groups live in the most deprived areas of the country and are exposed to multiple discriminations.  The representatives of these ethnic writers, artists and activists have repeatedly raised their concerns about these blatant discriminations.  In fear of a unity between these ethnic rights activists and the broader struggle against the dictatorship in Iran, the I.R.I. has issued more death sentences against these activists than ever. For this very reason, the majority of activists facing a death sentence in Iran today are Kurd, Arab or Baluchi political prisoners. 

Once again, we offer our full support of the U.N. resolution against I.R.I’s dismal human rights record and demand that the international community of human rights and political organizations as well as all the peace-loving nations of the world voice their opposition to any possible retaliation by the I.R.I. in response to the recent U.N. resolution.  By giving special attention to those Iranians whose lives are inimminent danger, the international community could help stop the I.R.I. from taking away their lives.

We demand an immediate end to all executions in Iran and request all political, social and civic prisoners to be given retrial under fair and humane conditions.

سرکوب و نقض حقوق بشر در ایران را محکوم کنیم
و همگی همصدا به مجازات اعدام بگوئیم نه!


دراجلاس ۲۰ دسامبر ۲۰۱۲ (۳۰ آذر ۱۳۹۱)، مجمع عمومی سازمان ملل با اکثریت قاطع، نقض فاحش حقوق بشر در ایران و سرکوب مدافعان حقوق بشر را محکوم کرد. این اولین بار نیست که مجمع عمومی سازمان ملل پس از بررسی نقض حقوق بشر و سرکوب آزادی ها در ایران، کارنامه سیاه و ننگین جمهوری اسلامی در این زمینه را محکوم می کند
در این قطعنامه، با اشاره به نقض آشکار و مستمر حقوق بشر در ایران، ادامه سرکوب مخالفین سیاسی و فعالین مدنی، شکنجه و سرکوب اعتراضات صلح آمیز کارگران، آموزگاران، دانشجویان، زنان، اقلیت های قومی و مذهبی، حکومت جمهوری اسلامی برای چندمین بار محکوم گردیده است. ما با تقدیر از این افدام جامعه جهانی در محکوم کردن نقض حقوق بشر در ایران و ادامه آن از طرف جمهوری اسلامی، توجه جامعه جهانی و تمام کوشندگان حقوق انسانی را به چند نکته مهم زیر جلب می نماییم:
-     در جمهوری اسلامی ایران، ارزش گذاری بر کرامت انسانی محور  قانونگذاری نیست. قوانین جاری در این حکومت بر اساس معیارهای شرع اسلام تدوین شده اند. قانون گذاران و مجریان قانون در جمهوری اسلامی برابری حقوق شهروندان را که اساس قوانین قضایی پذیرفته شده در جهان است قبول نداشته و ایرانیان را بر مبنایِ باورهایِ دینی یک اقلیتِ در حکومت، به شهروندان درجه یک و دو و ... تقسیم کرده اند. در حقیقت، قوانین جاری قضائی دراین حکومت، ناقض بسیاری از میثاق های بین المللی است.
-     قوه قضائیه که در یک جامعه مدرن و دموکراتیک مستقل از قوه مجریه و پاسدار حقوق شهروندان است، در جمهوری اسلامی آلتِ دست حکومتگران و به ویژه شخص ولی فقیه بوده و به مهمترین ابزار سرکوب شهروندان تبدیل شده است.
-     در  ۳۴ سال گذشته، روش اصلی برخورد جمهوری اسلامی با شهروندان ایرانی، سرکوب آزادی ها و نقض مستمر حقوق بشر بوده است. برای ایجاد وحشت در جامعه، اجرای مجازات های قرون وسطایی یکی از حربه های اصلی جمهوری اسلامی در همه این سال ها بوده و اجرای مجازات های وحشیانه ای مثل سنگسار و قطع اعضای بدن را از همان ابتدای روی کار آمدنش آغاز کرده است.
-     در این میان و از همان ابتدا، مجازات اعدام مهمترین حربه جمهوری اسلامی برای ایجاد وحشت در میان شهروندان بوده است. قوه قضائیه و یا در حقیقت ماشین کشتاری که از همان روزهای اول با ایجاد «دادگاه» های مختلف به راه افتاد، با دست آویزهای مختلف ده ها هزار حکم اعدام صادر کرده و به زندگی ده ها هزار شهروند ایرانی با بیرحمی تمام پایان داده است. تنها در پنج سال گذشته 2843 نفر در ایران اعدام شده اند[1].
-     در همه این سال ها، از ده ها هزار شهروند ایرانی که به دست جمهوری اسلامی اعدام شده اند بخش بزرگی را مخالفین حکومت تشکیل داده اند. به ویژه در سال های سیاه پس از انقلاب 1357، جمهوری اسلامی برای محکم کردن پایه های حکومتش دست به کشتار وسیع مخالفین زد. در سال های اخیر، گرچه حکم اعدام بیشتر برای جرائم عادی صادر و اجرا شده است، ولی قوه قضائیه که همچنان آلتِ دستِ دستگاه های امنیتی رژیم بوده و گوش به فرمان آنها دارد، به صدور حکم اعدام برای مخالفین جمهوری اسلامی و کشتار آنها ادامه داده است.

از آنجا که حکومت اسلامی در ایران همواره پس از محکوم کردن عملکردش توسط جامعه جهانی و ارگان های بین المللی ناظر به حقوق بشر، به اقدامات تلافی جویانه دست زده است، ما توجه آزادیخواهان جهان، نهادهای مدافع حقوق بشر و دولت ها را به خطری که جان تعدادی از زندانیان سیاسی ایرانی را تهدید می کند جلب می کنیم.
هم اکنون تعداد زیادی از کنشگران مدنی و فعالین اجتماعی و سیاسی محکوم به اعدام در سلول های مرگِ زندان های جمهوری اسلامی به سر می برند و هر لحظه ممکن است مجازات بیرحمانه اعدام در باره آنها اجرا شود. ما از فرصت تاریخی محکوم کردن دوباره حکومت ایران به وسیله سازمان ملل به خاطر نقض حقوق بشر و استمرار سرکوب شهروندان ایرانی بهره برده و توجه تمامی کنشگران حقوق بشر را به وضعیت محکومین زیر اعدام جلب می کنیم.

البته باید یادآوری کرد که بیشتر مخالفین جمهوری اسلامی که در سال های اخیر اعدام شده اند از کردها، عرب ها و بلوچ های ایرانی بوده اند. کردها، عرب ها  و بلوچ ها در محروم ترین مناطق ایران زندگی می کنند و در جمهوری اسلامی از ستم و تبعیض هایی چندگانه رنج می برند. هنرمندان، نویسندگان، فعالین مدنی و سیاسی آنها همواره نسبت به این شرایط اعتراض داشته اند. برای پیشگیری از گسترش این اعتراض ها به توده های عرب، کرد و بلوچ، و پیوند این اعتراض ها با جنبش سراسری ضد دیکتاتوری ایران، جمهوری اسلامی همواره با بیرحمی تمام به این کنشگران مدنی و فعالین سیاسی برخورد کرده است. و درست به این دلیل هم اکنون بخش اصلی فعالین محکوم به اعدام در زندان های جمهوری اسلامی بلوچ، عرب و یا کُرد هستند.
ما بار دیگر با استقبال از قطعنامه مجمع عمومی سازمان ملل در محکوم کردن سرکوب و نقض حقوق بشر در ایران، افکار عمومی جهان، نهادهای حقوق بشری، احزاب و سازمان های سیاسی و دولت ها را نسبت به واکنش انتقام جویانۀ جمهوری اسلامی هشدار می دهیم و از همه آنها می خواهیم اعتراض خود را نسبت به نقض حقوق بشر و اعدام شهروندان ایرانی قطع نکنند و از یاد نبرند که زندانیان سیاسی محکوم به اعدام ممکن است هر لحظه قربانی انتقام جویی جمهوری اسلامی شوند.
ما خواستار لغو مجازات اعدام در ایران هستیم و تاکید می کنیم که تمام مجرمین کیفری محکوم به اعدام باید دوباره در دادگاه های عادلانه محاکمه شوند و مجازاتی انسانی و برابر با جرم آنها برایشان در نظر گرفته شود.
ما همچون همیشه خواستار آزادی بی قید و شرط تمام زندانیان سیاسی و عقیدتی هستیم.
